These Terms of Service (“Terms”) constitute a legally binding agreement between Team DeLacy LLC, a Texas limited liability company doing business as Team DeLacy Electronics (“we,” “us,” or “our”), and you (“you” or “your”).

The website and online store at team-delacy-electronics.myshopify.com (the “Site”) and related services (collectively, the “Services”) are operated by Team DeLacy LLC.

By accessing, browsing, or using the Services, or by placing an order, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, you must not use the Services.

Your use of the Site constitutes your acceptance of these Terms. We reserve the right to modify, update, or replace these Terms at any time without prior notice. The effective date will be posted at the top of this page. Continued use of the Site after changes means you accept those changes. We recommend reviewing these Terms periodically.

2. Who We Are

Team DeLacy Electronics is a Texas-based online retailer specializing in consumer electronics sold individually or in bundles.

The Site is powered by Shopify Inc., which provides e-commerce hosting and payment processing services. All orders placed through the Site are processed and fulfilled by us. We may use third-party logistics partners for storage, packing, and shipping, but we remain the merchant of record and are solely responsible for customer service, refunds, and product quality.

3. Eligibility

You must be at least eighteen (18) years old or the age of majority in your jurisdiction to use the Site or purchase products. By using the Site, you represent and warrant that you meet this requirement and have the legal capacity to enter binding contracts.

4. Account Registration

Certain features may require a customer account. You agree to provide accurate, current, and complete information during registration.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at teamdelacy@gmail.com of any unauthorized access.

We reserve the right to suspend or terminate accounts for violations of these Terms.

5. Orders, Acceptance, and Cancellation

Placing an order constitutes an offer to purchase.

We reserve the right to accept, decline, modify, or cancel any order for any reason, including product availability, pricing errors, suspected fraud, or legal compliance.

An order is accepted only when we send a confirmation email and process payment. Until then, no contract exists.

Prices are subject to change without notice.
The price displayed at checkout is final and includes applicable taxes or fees.
Shipping costs are added separately.

After acceptance, cancellations are at our discretion. If canceled, we will refund the full amount to your original payment method.

6. Products and Product Descriptions

Product descriptions, images, specifications, and pricing are provided for informational purposes only. Actual products may vary due to manufacturing differences or device displays.

Products are sold “as-is” and “as-available,” with no implied warranties beyond any manufacturer warranty provided at the time of sale.

We reserve the right to discontinue products, change specifications, or limit quantities at any time without notice.

7. Shipping, Delivery, and Title

Orders are fulfilled by us using third-party logistics partners.

Estimated delivery for U.S. orders shipped from domestic warehouses is three (3) to Fifth teen (15) business days. International delivery estimates vary.

Delivery estimates are not guarantees. We are not liable for delays caused by carriers, customs, weather, or other events beyond our control.

Tracking information is provided by email once shipped.
Title to products passes to you upon delivery.
Risk of loss or damage passes to you when the carrier takes possession.
We are not responsible for lost packages after handover to the carrier.

8. Returns, Refunds, and Warranty

14-day window from delivery
No physical return required (keep the item)
Full refund for defects or damage
Partial refund for minor issues
Shipping costs are non-refundable
Exchanges are handled via refund-then-reorder

We provide no additional warranties beyond manufacturer warranties.

9. Payment and Security

We accept major credit cards, PayPal, and Shopify Pay.

All transactions are processed securely through Shopify Payments or third-party processors.

You authorize us to charge your payment method for the full order amount, including taxes and shipping.
We may require additional verification for high-risk orders.
Refunds are issued to the original payment method within three (3) to five (5) business days after approval.

10. Intellectual Property

All content on the Site—including text, graphics, logos, images, and software—is owned by us or our licensors and protected by U.S. and international intellectual property laws.

You may use the Site for personal, non-commercial purposes only. Unauthorized reproduction, distribution, modification, or derivative works are prohibited.

11. Prohibited Conduct

You agree not to:

We do not guarantee error-free operation or that the Site is free from viruses.

14. Limitation of Liability

To the fullest extent permitted by law, Team DeLacy Electronics, Shopify, and our affiliates, suppliers, and partners are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill.

Our total liability is limited to the amount paid for the specific order giving rise to the claim. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

You agree to indemnify and hold harmless Team DeLacy Electronics, Shopify, and our affiliates, officers, employees, agents, and suppliers from claims, damages, or expenses arising from:

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules.

Any disputes shall be resolved exclusively in the state or federal courts located in Texas. You consent to jurisdiction and venue there.

17. Severability

If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.

18. Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

19. Assignment

We may assign these Terms without notice. You may not assign them without our written consent.

20. Entire Agreement

These Terms, along with our Privacy Policy and order confirmations, constitute the entire agreement between you and us.

21. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including strikes, natural disasters, pandemics, or similar events.
